This is an application by the fathers of Martin
McCaughey and Desmond Grew, who were killed by soldiers
on 9 October 1990, for Judicial Review of the decisions
of the Chief Constable and the Coroner concerning the
disclosure of documents for the purposes of the Inquests
into the deaths, in particular in relation to the
disclosure to the Coroner of three documents retained by
police. First, a copy of the police report prepared for
the Director of Public Prosecutions. Second, the DPP
directions in response to the police report, which
directed no prosecution. Third, unredacted copies of
intelligence reports gathered by the police, redacted
copies having been forwarded to the Coroner by the
police. Application granted in respect of the first and

declaration that the respondent, the Secretary of State
for Northern Ireland, in breach of Section 6 of the
Human Rights Act 1998 and Article 2 of the European
Convention for the Protection of Human Rights and
Fundamental Freedoms 1950 ("The European Convention
on Human Rights") had failed to provide the
applicant with an Article 2 compliant investigation into
the death of his son and, further, for an order of
Mandamus compelling the respondent to provide the

Mrs McBride is the mother of Peter McBride who was shot
dead by two serving soldiers, Guardsmen Wright and
Fisher, ("the Guardsmen") on 4 September 1992.
Those soldiers were subsequently convicted of his
murder. Subsequent to their release from prison on 1
September 1998 the Army Board decided that they should
be retained in the Army. That decision was subsequently
the subject of a successful challenge before Kerr J
("McBride No.1"). The Army Board subsequently
reconsidered its decision and on 21 November 2000 again
decided that the seven factors which it listed, taken
together, constituted "exceptional reasons"
justifying the retention of the Guardsmen in the Army.
